These Terms of Use (“Terms of Use”) govern your use of any website or mobile application operated by Label GOAT (“Label GOAT,” “we,” “us,” or “our”) that links to these Terms of Use, including our websites currently located at WWW.LABELGOAT.COM including our ” Label GOAT” mobile applications (such websites and mobile applications collectively, this “Site”). Your agreement to these Terms of Use is a condition precedent to using this Site. Please read these Terms of Use carefully before proceeding.
Binding Effect
BY USING THIS SITE, YOU AGREE, WITHOUT LIMITATION OR QUALIFICATION, TO BE BOUND BY THESE TERMS of Use, TO WHICH WE RESERVE THE RIGHT TO MAKE CHANGES FROM TIME TO TIME, CONSISTENT WITH APPLICABLE LAW. IF YOU DO NOT AGREE TO THESE TERMS of Use, DO NOT USE THIS SITE. PLEASE BE AWARE THAT these Terms of Use contain a binding arbitration agreement and class action waiver that waive your right to a court hearing and jury trial.
Additional Terms
In addition to these Terms of Use, your use or purchase of, or participation in, certain products, services, or contests offered on our Site may require you to accept additional terms and conditions applicable to such products, services, and/or contests (collectively, “Additional Terms”). The Additional Terms are incorporated and made a part of these Terms of Use by this reference.
Age Requirements for General Use of this Site
You must be at least the age of majority in your state of residence and fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties herein in order to access this Site and purchase services and/or products from us. Individuals under the age of majority are not eligible to use this Site and may not submit any personal information to us. By using this Site, you hereby represent and warrant that you are at least the age of majority in your state of residence and that you are legally able to enter into any and all purchase agreements with us and our partners, vendors, agents, and service providers.
Modification to these Terms of Use
We will post a notification on this Site in the event of any material changes to these Terms of Use. Such changes, whether in the form of modifications, additions, or deletions, shall be effective when specified in the relevant notification or, if the change is immaterial, immediately upon appearing on this Site. Please check these Terms of Use periodically for changes. Your continued use of this Site following our posting of any changes to these Terms of Use means that you accept those changes.
Creating and Accessing Your Account
In order to access certain information or services on our Site, you may be required to create an account and provide certain personal information such as your name and email address.
You must treat your account information (including, without limitation, your password and any other piece of information required as part of our security procedures) as confidential, and you must not disclose the foregoing to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Site or portions of it using your username, password, or other security information.
You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You agree to be responsible for any use of this Site or portions of it (including, without limitation, all orders placed and for all activities that occur) using your username, password, or other security information. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer or device so that others are not able to view or record your password or other personal information.
User Content
When using the Label GOAT Service, you are providing us a license to User Content as set forth in the Terms of Use. You agree that you shall be solely responsible for any violations of any relevant laws and for any infringement of third party rights caused by any User Content (as defined in the Terms of Use) that you provide or transmit to us. You may not submit any User Content that:
- Contains any unlawful, threatening, abusive, libelous, defamatory, discriminatory, obscene, vulgar, pornographic (including, but not limited to, child pornography), profane, obscene, lewd, lascivious, filthy, vile or indecent information of any kind, including images and language;
- Contains any message that constitutes, encourages, or incites conduct that would constitute a criminal offense or give rise to civil liability;
- Contains a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States or a threat of blackmail; or
- Contains any information or other material that violates or infringes upon the rights of Label GOAT or any third party, including material that is an invasion of privacy or publicity rights; is protected by copyright, trademark, or other proprietary rights; or is a derivative work with respect thereto, without first obtaining permission from the owner or right holder.
You acknowledge that Label GOAT does not pre-screen User Content. Label GOAT and its affiliates reserve the right (but not the obligation) to remove any User Content, at any time, for any reason, in their sole discretion, including, but not limited to, when User Content violates these Terms of Sale or may otherwise be objectionable.
You further acknowledge and agree that Label GOAT may preserve User Content and may also disclose User Content if required to do so by law or if there is a certain belief that such preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce these Terms of Sale; (iii) respond to claims that the User Content violates the rights of third-parties; or (iv) protect the rights, property, or personal safety of Label GOAT, its users, and the public.
We advise that you keep a copy of all User Content uploaded to Label GOAT, as we will not be able to send back any of your files/content at any given time. Label GOAT maintains no guarantee that User Content uploaded into our system or provided by us as a background, template, or clip art asset will be available in the future. After order fulfillment, your User Content and the proofs that Label GOAT sent you may be removed/deleted at any time without notice.
Customer Submitted Artwork or Graphics
All artwork or designs and images submitted by you must be provided in AI, PDF, EPS, or TIF Formats, excluding products labeled otherwise (more information available on product details and file setup tabs). Label GOAT is not responsible for any color shift.
Label GOAT is not responsible for color dropouts or incorrect color conversions when converted to CMYK. All artwork, designs, and images submitted by you must be provided in a minimum of 300 DPI and CMYK color mode (unless otherwise stated). Additional fees may apply for files larger than 30MB. Label GOAT is not responsible for images printed as fuzzy, distorted, or pixilated due to you providing Label GOAT a low-resolution, RGB, or otherwise incorrectly-prepared artwork, design, and/or image. Further, Label GOAT is not responsible for overprint designs or non-flattened files printing in error. Label GOAT Is not responsible for production delays for any reason, including any delays caused by customer file errors or by customers requesting or needing to re-upload files due to not meeting proper print specifications.
Color Proofing, Matching & Printing
Label GOAT is not liable for color matching or ink density on screen proofs approved by you. Screen proofs will predict design layout, text accuracy, image proportion, and placement, but not color or density. Label GOAT will use commercially reasonable efforts to match the gradient density of each color, but Label GOAT is not liable for the final appearance of a color.
Payment
Important: Your order will not be processed until payment is received in full.
Checks
Please be advised that we do not accept checks from customers.
Sales Tax
Please be notified that sales tax may apply to your order(s).
Coupons and Free Shipping
All coupons are limited to one-time use only. Coupons cannot be combined with another coupon, offer, or discount, or with free shipping. Coupons may be valid for a limited time only. See specific coupons for discount codes and details. The maximum discount amount permitted by the use of a coupon is $100. The discount applies to the printing cost only and is not applicable to tax or shipping and handling charges. Coupons cannot be applied to certain orders including, but not limited to, orders containing custom quotes.
All coupons must be applied at the time of checkout unless otherwise stated. Coupons cannot be applied after the order has been placed. For free standard shipping, no coupon is required. Terms for free shipping may vary per order and may be valid for a limited time only. Free standard shipping applies to the Continental U.S. only and excludes Hawaii & Alaska. Free standard shipping excludes rush orders. Free shipping and a coupon, offer or discount cannot be applied at the same time. We reserve the right to suspend any coupons or shipping and handling discounts at any time without notice.
Returns and Refunds
At Label GOAT, we provide our Users with the best possible label printing experience. If customers are not 100% satisfied with their order for any reason, please contact our customer service department. All policies are subject to change without prior notification. Defective product refunds and reprints shall not exceed the amount paid by the User or $500 (whichever is less). Determination of defect is at the sole discretion of Label GOAT.
In most cases, Users will be requested to submit digital photos documenting the product defect and/or ship the defective products back to customer service. Free expedited reprint on any orders lost in transit is limited to orders less than or equal to $500. Turnaround and shipping for reprint orders will vary depending upon available production capacity.
Order Shipping & Delivery
Label GOAT will use commercially reasonable efforts to ensure that delivery schedules are met. Notwithstanding the foregoing, Label GOAT is not liable for any delays in shipping. In no event shall Label GOAT be liable for any direct, indirect, consequential, or incidental damages resulting from any delay in shipment or delivery for any reason including, but not limited to, delays in shipments caused by weather conditions, shipping company delays, increase in volume during the holiday season, information received on a holiday or a non-business day, international customs issues or any other circumstances beyond Label GOAT direct control.
Label GOAT shipment and delivery dates are merely estimates calculated based upon estimates provided by our suppliers and cannot be guaranteed. When a package is not delivered due to an error made by you in submitting the proper shipping address, Label GOAT will reship the package with the corrected address and charge an additional shipping fee for the shipment for which you will be responsible. Please note that section applies to all orders.
Please be advised that we do not combine different items or orders for shipping. Due to the nature of gang-run printing, each item may be placed on a separate batch, and each batch may be completed at a different time than the rest of the items on the order. Thus, we ship each item separately to ensure you receive your products as soon as they are ready. We may combine shipping for certain items that have the same options, such as paper stock, quantity, etc.
Further, please note that due to size limitations, we will not ship to PO Boxes. Title and risk of loss pass to you upon our transfer of the products you ordered to the carrier responsible for delivery. Label GOAT is not responsible for any delays or damages caused during transit or delivery, for any 3rd party shipping errors or omissions, nor for any charges or fees incurred due to packages that were lost or damaged in transit.
Shipping Method for International Orders
Label GOAT does not ship directly out of the country.
